About
The members of our Litigation Group are effective and determined advocates who draw on their significant experience to successfully resolve our clients' disputes. Our litigators handle all phases of the litigation process, including pre-litigation negotiations, trial and appellate work, and private arbitration and mediation proceedings. We regularly appear in both federal and state courts in Connecticut and, because many of our clients have a national presence, we frequently appear in other jurisdictions as well. We also serve as local counsel to assist out-of-state attorneys when their clients are involved with litigation in Connecticut. Outside of the courtroom, we counsel our clients in risk awareness and avoidance and help them to identify, evaluate, and prepare for potential disputes. Our goal is to further our clients' strategic objectives by achieving cost-effective and lasting solutions both in and out of the courtroom.

Business Disputes/Commercial Litigation
Our business and commercial litigation attorneys handle virtually every type of business dispute and lawsuit. Representing business entities and individuals in both state and federal court, our attorneys are skilled at handling complex cases. Our attorneys focus on protecting and preserving our clients’ interests through constant client involvement and communication. We guide clients in identifying risks and risk avoidance and in quantifying litigation decisions with an eye toward cost containment, partnering with them throughout the entire process. From the very outset of a problem, we examine all possible issues, opportunities for resolution, and outcomes from both a legal and business perspective, taking into account the financial and other burdens presented by dispute resolution. We engage in careful planning with our clients in developing a strategy for a successful outcome.
We also represent clients in litigation arising from copyright disputes, and matters involving the misappropriation of trade secrets.
In addition to the above, we have substantial experience in complex jury and bench trials, as well as representing clients in complex arbitration proceedings and mediated dispute resolution.
Real Estate Litigation
Our real estate litigators are involved in all aspects of litigation including resolution of disputes involving office buildings, retail and shopping centers, redevelopment projects, and apartments and other multifamily developments. We have acted as counsel for both plaintiffs and defendants in a wide range of litigation matters including property valuation and municipal taxation, business torts, construction defects, municipal tort liability, contract disputes, and land use disputes. We also represent clients in connection with disputes arising under commercial landlord/tenant relationships and real property foreclosure.
Creditors’ Rights & Bankruptcy Litigation
Our attorneys represent clients in the collection and defense of all types of secured and unsecured claims, and regularly prosecute and defend actions in state and federal courts involving prejudgment remedies, fraudulent transfers, the appointment of receivers, mortgage foreclosures, attachments, garnishments, replevin (recovery of personalty), corporate dissolution, and secured transactions under the Uniform Commercial Code.
In bankruptcy cases, our attorneys regularly litigate matters arising in both reorganization and liquidation proceedings, including but not limited to, preference actions, relief from stay, proof of claim objections, and involuntary petitions. Creditors’ rights and bankruptcy matters move quickly and circumstances can change rapidly. Our attorneys take aggressive and decisive action at the start of a matter, which often produces better results and lower costs for our clients. We complement our assertive and proactive litigation with skillful and experienced negotiating. In bankruptcy cases in particular, we combine aggressive litigation with skillful negotiating and consensus building to achieve our clients' goals. Opposing counsel often refer to us as their most formidable adversaries and their most effective negotiating partners.
Municipal Law
Our municipal litigators provide experienced legal counsel to municipal clients and develop long-lasting relationships with the personnel responsible for the day-to-day operations of our towns and cities. We provide counsel to boards of selectmen, agencies, boards, and commissions in all aspects of municipal administration and procedure, including drafting ordinances and providing interpretative guidance on statutes, ordinances, and regulations. We also represent clients on both sides of civil litigation and adversarial proceedings involving municipalities such as property tax appeals, administrative appeals, Freedom of Information complaints, and planning, zoning, and wetlands applications and appeals.
Employment Counseling and Litigation
Our employment litigation attorneys provide counseling on a broad range of matters, from routine discharge and disciplinary disputes, to sexual harassment and discrimination claims. We represent clients before federal and state courts and administrative agencies, and in arbitration, mediation, and other dispute resolution settings. We also represent our clients in connection with non-competition, non-solicitation, and confidentiality agreements at the negotiation, documentation, and enforcement stages. In addition, we assist our clients in the preparation of employee policies and manuals, and provide comprehensive seminars with respect to a wide array of issues that arise in the employment relationship, such as sexual harassment and discrimination.
Environmental Litigation
Our litigators represent business entities and individuals in environmental litigation in state and federal courts and in administrative proceedings before the Connecticut Department of Energy and Environmental Protection and the U.S. Environmental Protection Agency. We have represented Potentially Responsible Parties in major Superfund cases and in other private cost recovery cases brought under federal and state law. We also counsel current owners, former owners, and tenants on their responsibility for the cleanup of contaminated sites and represent them in litigation arising out of disputes over cleanup and related costs.
Probate Litigation
Our trusts and estates lawyers represent individuals and families, non-profit organizations, beneficiaries, heirs, and individual and corporate executors and trustees in connection with a wide variety of contested probate, tax and fiduciary matters, including the following:
- Will contests, including lack of capacity and undue influence claims
- Will and trust construction actions
- Breach of fiduciary duty claims
- Valuation disputes and accountings
- Income, gift and estate tax audits and appeals
- Trust modification and termination actions
We have represented clients in both the Connecticut Probate and Superior Courts and have appeared pro hac vice in other states.
